However, please refrain from advertising competitions or other services of a commercial nature. We work hard to offer you this free service and simply ask that you help us in return by submitting your site to our Prize Directory, which is intended for this purpose.

Before using Win a Car Prize, please look over the following terms and conditions. If you do not agree to abide by these terms, please do not use this site. Users represent that they have read, understand, and agree to this.

b. "Site" means the collection of web pages that can be accessed via this website, as well as any successor web pages or other technology as may be designated by the Hosts.

c. "Terms" means these Terms of Use.

d. "Use" and its variants are meant in their broadest sense, including, but not limited to, the acts of using, accessing, receiving, browsing, downloading from, and uploading to. A "User" is a person or entity who Uses the Site.

e. "You" means you personally, as well as any person or entity on whose behalf you are Using the Site.

f. “Content” includes any information or data of any kind found on WinaCarPrize.co.uk, including chat forums, articles, photographs or graphics, video, music or sound, databases, graphics, software or other materials.

Unless otherwise specified, the terms "includes", "including", "e.g.,", "for example", and other similar terms are deemed to include the term "without limitation" immediately thereafter. WCP provides its service to you, subject to the following Terms of Use, which may be updated from time to time without notice. You are encouraged to check back frequently, as our Terms of Use may change.

Description of Service

WCP currently provides users with access to a collection of resources, including, a directory of car competitions and raffles, a discussion forum and a user account allowing them to communicate with other registered users (the "Service"). You understand and agree that the Service may include advertisements, sponsored links, promotional listings, or paid placement. You also understand and agree that the Service may include certain communications from Us, such as service announcements, administrative messages and the newsletter, and that these communications are considered part of the Service. Unless explicitly stated otherwise, any new features enhancing the current Service, including the release of new features and services, shall be subject to the Terms of Use.

Registration

If you choose to register a password protected user profile with WCP - which is required if you want to submit your site in the Directory; communicate with others or participate in the Forum; or take advantage of such other services as may be offered only to users with a profile - you agree to: (a) provide true, accurate, current and complete information about yourself and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or We have reasonable grounds to suspect that such information is untrue, We have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

Eligibility

Membership in the Service is void where prohibited. This Site is intended solely for users who are sixteen (16) years of age or older. Any registration by, use of or access to the Site by anyone under 16 is unauthorised, unlicensed and in violation of these Terms of Use. By using the Service or the Site, you represent and warrant that you are 16 or older and that you agree to and to abide by all of the terms and conditions of this Agreement.

Registration Data; Account Security

In consideration of your use of the Site, you agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security and confidentiality of your password and identification; (c) maintain and promptly update the Registration Data, and any other information you provide to Company, to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and for any actions that take place using your account. You agree to immediately notify Us of any unauthorised use of your password or account or any other breach of security. We are not liable for any loss or damage arising from your failure to follow these instructions.

All of the content on our site is owned by us or our licensors and is protected by UK and international copyright laws. You are allowed to use our content for personal, non-commercial use only. You may make one copy of extracts from this site on any single computer for personal, individual use only, provided that all copyright and proprietary notices are kept intact. Apart from that, none of our content may be republished, posted, transmitted, stored, sold, distributed or modified without our prior written consent.

User Conduct

  • upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
  • upload, post, transmit, share, store or otherwise make available any photos other than those that: (i) are of you or your friends, (ii) are taken by you or your friends, or (iii) are original photos or art created by you or your friends (iv) are original photos or art produced specifically for the purpose of running a competition or (v) come with relevant permissions from the photographer and any other copyright owner;
  • register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity, unless you have obtained express permission from them to assist them in promoting a car competition on their behalf;
  • impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
  • upload, post, transmit, share or otherwise make available any unsolicited or unauthorised advertising, solicitations, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation;
  • upload, post, transmit, share, store or otherwise make publicly available on the Site any private information or personally identifiable information of any third party, including, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers;
  • solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
  • upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • intimidate or harass another;
  • upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offence, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
  • use or attempt to use another's account, service or system without authorisation from the Company, or create a false identity on the Service or the Site;
  • upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of Company, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose Company or its users to any harm or liability of any type;
  • use information or content you obtained on the Site or service in any manner not authorised by Our Code of Conduct or Terms of Use.

Without limiting any of the foregoing, you also agree to abide by our Code of Conduct outlined below, that provides further information regarding the authorised conduct of users on our site.

Your Content

You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, notes, text, information, advertisements, listings, music, video, graphics, and other content that you upload, publish or display (hereinafter, "post") on or through the Service or the Site, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post.

If you wish to advertise the details of your site or competition on our site, please submit it to the Directory via the Directory Submission service. Find out more about our services for Publishers.

You understand and agree that the Company may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of the Company violates this Agreement or our Code of Conduct outlined below, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to the Company.

When you post User Content to the Site, you authorise and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the User Content on the Site. By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide licence (with the right to sublicence) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorise sublicences of the foregoing.

If you wish to delete your account, you may do so at any time by logging into the Site and following the instructions provided in the relevant section of your account. Unless you explicitly request us to do so in writing, while your profile details will be deleted; some of your User Content will remain on Site. This includes any communications with other users, and comments, posts, forum discussions associated with your deleted account. You may request for us to remove all your User Content from the Site (apart from private messages sent from your account to other users) by contacting us. If you choose to remove your User Content, the licence granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content. We do not assert any ownership over your User Content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content.

Content Code of Conduct

We want our site to be a place where people respect the rights and feelings of others, including third-party intellectual property rights. Therefore, we have established certain rules for using our site and for posting messages, photos and other content on our site, which are set forth in our Terms of Use and in this User Code of Conduct. WHEN YOU USE OUR SITE, YOU ARE AGREEING TO ABIDE BY THE USER CODE OF CONDUCT AND THE OTHER RULES SET FORTH IN OUR TERMS OF USE. FAILURE TO ADHERE TO THIS CODE OF CONDUCT AND THE TERMS OF USE MAY RESULT, AMONGST OTHER THINGS, IN TERMINATION OF YOUR ACCOUNT AND THE DELETION OF CONTENT THAT YOU HAVE POSTED ON OUR SITE WITH OR WITHOUT NOTICE, AS DETERMINED BY US IN OUR SOLE DISCRETION.

Third-Party Content

WCP allows you to upload and share user generated Content with your friends, including photographs. This means that you may post and share original photographs that are of a personal nature that: (i) are of you or your friends, (ii) are taken by you or your friends, or (iii) are original photos or art created by you or your friends (iv) are original photos or art produced specifically for the purpose of running a competition. It is not intended as a place for you to post third-party copyrighted content, such as the content taken from other websites or popular magazines. In addition, we expect our users to use good judgement and respect the copyrights and other intellectual property rights of others. Therefore, in using our site, you may not:

  • upload or share any photographs, videos or other Content other than original works created by you or another user;
  • post or share any Content that infringes upon or violates the copyright, trademarks or other rights of any third party;
  • attempt to circumvent any content filtering techniques we may employ;
  • Inappropriate Content.

While we believe users should be able to express themselves and their point of view, certain kinds of speech simply do not belong in a community like WCP. Therefore, you may not post or share Content that:

  • is obscene, pornographic or sexually explicit;
  • depicts graphic or gratuitous violence;
  • makes threats of any kind or that intimidates, harasses or bullies anyone;
  • is derogatory, demeaning, malicious, defamatory, abusive, offensive or hateful.

Competition Directory Listings and Reviews: Rules of Acceptable Use

The Competition Directory Listing and Review Service ("Directory Service") is intended to provide a platform for you to exchange information, opinions and comments. Please remember that this is a public space, open to all age groups, so whilst we welcome your contributions, please word your comments appropriately. In addition to agreeing with the general User Conduct requirements described above when contributing to the Directory, you grant Us (and others authorised by Us) the unrestricted right to use, reproduce, translate and distribute any material you place on the Web site. In order to submit a site to the Directory, you will be required to agree to our Publisher Terms of Service. We reserve the right (but undertake no duty) to review, edit, move or delete any material on this site, at our sole discretion.

Repeat Infringer Policy

In accordance with applicable law, Company has adopted a policy of terminating, in appropriate circumstances and at Company's sole discretion, members who are deemed to be repeat infringers. Company may also at its sole discretion limit access to the Site and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Group Pages

Group Pages are group profiles used solely for commercial, political, or charitable purposes. You may not set up a Group Page on behalf of another individual or entity unless you are authorised to do so. This includes fan Group Pages, as well as Group Pages to support or criticise another individual or entity.

WE DO NOT PRE-SCREEN OR APPROVE GROUP PAGES, AND CANNOT GUARANTEE THAT A GROUP PAGE WAS ACTUALLY CREATED AND IS BEING OPERATED BY THE INDIVIDUAL OR ENTITY THAT IS THE SUBJECT OF A GROUP PAGE. NOR ARE WE RESPONSIBLE FOR THE CONTENT OF ANY GROUP PAGE, OR ANY TRANSACTIONS ENTERED INTO OR OTHER ACTIONS TAKEN ON OR IN CONNECTION WITH ANY GROUP PAGE, INCLUDING HOW THE OWNER OF THE GROUP PAGE COLLECTS, HANDLES, USES AND / OR SHARES ANY PERSONAL INFORMATION IT MAY COLLECT FROM USERS (PLEASE REVIEW OUR PRIVACY POLICY IF YOU HAVE ANY QUESTIONS OR CONCERNS REGARDING THE USE OR SHARING OF YOUR PERSONAL INFORMATION). YOU SHOULD BE CAREFUL BEFORE PROVIDING ANY PERSONAL INFORMATION TO OR ENTERING INTO ANY TRANSACTION IN CONNECTION WITH A GROUP PAGE.

Authorisation

Group Pages may only be set up for the purpose of promoting a business or other commercial, political, or charitable organization or endeavor (including non-profit organisations) that is related to car competitions, raffles or sweepstakes, and only by an authorised representative of the entity or individual that is the subject of the Group Page. By creating a Group Page, you represent and warrant that you are authorized to do so by the person or entity that is the subject of the Group Page, and to accept these Additional Terms and Our Terms of Use on such person's or entity's behalf. When you create a Group Page, you must designate one or more administrators who are authorised to operate and edit the Group Page.

We do not review Group Pages to determine if they were created by an appropriate party, and are not responsible for any unauthorised Group Pages that may appear on the Site. If there is any dispute as to whether a Group Page has been created or is being maintained by an authorised representative of the individual or entity who is the subject of that Group Page, then We shall have sole right, but are not obligated, to resolve such dispute as We determine is appropriate in Our sole discretion. Such resolution may include, without limitation, deleting or disabling access to Group Pages or any portion thereof at any time without notice.

Organizations or groups that promote or glorify hatred, violence, intolerance, racism or discrimination may not set up Group Pages. We reserve the right to delete or disable access to any such Group Pages.

Content

You are solely responsible for the creation, use and content of your Group Page and the URL you choose to be associated with your Group Page (your "URL"). Group Pages may include commercial content (Commercial Content), and can be used to conduct commercial activities, including but not limited to transactions, advertising, fundraising, contests, or promotions (Commercial Activities). Such Commercial Content and Commercial Activities may not be unlawful, fraudulent, false, or misleading in any manner.

All content contained in Group Pages must, when applicable, continue to comply with our Terms of Use, Code of Conduct, and Privacy Policy. We reserve the right to delete or disable access to any Group Page or any content that fails to comply with the terms of this section.

Trademark Policy

You represent and warrant that your Group Page, including any content contained therein, and your URL do not infringe in any way upon or violate the trademark or other rights of any third party. Although We have no obligation to screen or monitor any Group Page or URL, We reserve the right, but are not obligated, to resolve any complaints, disputes, or potential disputes regarding the infringement of any third party trademarks in connection with your Group Page or URL in any manner We deem appropriate in Our sole discretion. You agree to abide by and cooperate with the resolution of any such dispute as determined by Us, which may include, without limitation, deleting, changing or transferring control of a URL or deleting or disabling access to Group Pages or any content contained therein.

Privacy

If you collect or have access to any personal information from users (including without limitation personal information contained in any User profile), you agree to have users expressly authorise such collection or access, and any subsequent use, through an express opt-in process. You agree to use any such personal information only for the express purpose for which such personal information was provided by the user. You further agree not to share such personal information with any third party, except for service providers who are assisting you in carrying out the business you conduct on your Group Page and who are obligated to protect the privacy of such information and not to use such information for any purpose other than that for which it was provided. You agree to use reasonable measures to protect the security of any personal information you collect from users.

Indemnification

You agree to indemnify and hold the Company, its subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, legal fees, arising out of or in connection with any User Content or Third-Party Content you post or share on or through the Site, your use of the Service or the Site, your conduct in connection with the Service or the Site or with other users of the Service or the Site, or any violation of this Agreement or of any law or the rights of any third party.

Submissions

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Site or the Service ("Submissions"), provided by you to Company are non-confidential and shall become the sole property of Company. The Company shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Terms of Service

Please refer to our Terms of Service for the terms, conditions and policies applicable to your purchase of products or services from Company. By ordering products or services from Company through the Site, you agree to be bound by and accept the Terms of Service. The Terms of Service are subject to change without prior notice at any time, in Company's sole discretion so you should review the Terms of Service each time you make a purchase.

User Disputes

You are solely responsible for your interactions with other Site users. We reserve the right, but have no obligation, to monitor disputes between you and other users.

Registration Data and certain other information about you is subject to our Privacy Policy as set out below.

Indemnity

You agree to indemnify and hold WCP, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Sites you submit, or make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Use, or your violation of any rights of another.

No Resale of Service

You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.

General Practices Regarding Use

You acknowledge that We may establish general practices and limits concerning use of the Service. You agree that We have no responsibility or liability for the deletion or failure to store any messages and other communications or other Sites maintained or transmitted by the Service. You acknowledge that We reserve the right to deactivate accounts that violate our Terms of Use, or violate our Submission Policies. You further acknowledge that We reserve the right to change these general practices and limits at any time, in our sole discretion, with or without notice.

Termination

You agree that We, in Our sole discretion, may terminate your membership or password, delete your profile, Group page, Directory listing and any content or information that you have posted on the Site and/or prohibit you from using or accessing the Service or the Site (or any portion, aspect or feature of the Service or the Site) for any reason, or no reason, at any time in Our sole discretion, with or without notice, including, without limitation, if We believe that you are under 16 or you have violated the Terms of Use. When we are notified that a user has died, we will generally, but are not obligated to, keep the user's account active under a special memorialised status for a period of time determined by us to allow other users to post and view comments. We may also in Our sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Terms of Use may be effected without prior notice, and acknowledge and agree that We may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that We shall not be liable to you or any third-party for any termination of your access to the Service.

Advertisers

Your dealings with advertisers found on or through the Service are solely between you and such advertiser. You agree that We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

Because We have no control over such sites and resources, you acknowledge and agree that We are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Disclaimer of Warranties

In order to submit a competition for inclusion in the Directory, we require information from the user on our Directory listing order form. A user must also provide contact information (such as name, email and address). This information is used for billing purposes and to fill customer’s orders. If we have trouble processing an order, the information is used to contact the user.

Information Use

Profile

When you register with Us, you create your own profile and settings. While part of your Profile information will be available to any user visiting the site, other details are only be visible to users that are logged into the Site. We may occasionally use your name and email address to send you notifications regarding new services that we think you may find valuable. Profile information is used primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information.

We store information that we collect through log files, and via the information provided during the Directory Submit service, to create a profile of our users. A profile is stored information that we keep on individual users that details their characteristics. Directory Listings

Registered users that submit or edit an entry in the Competition Directory also receive a range of system emails to inform them of the progress of their submission. Once they have submitted their entry to the Directory, users receive one email confirming the submission will be reviewed by our editors once payment has been received. They receive a second email confirming the payment details required to complete the initial entry submission process. As soon as their entry has been approved and published, they receive a third email inviting them to check the entry details in the Directory. Users also receive system emails confirming that they have edited or renewed their listing.

Special Offers and Updates

Registered members will occasionally receive our newsletter, which features information on products, services, or special deals. Out of respect for the privacy of our users we present the option to not receive our newsletter. To do so, a user must submit their preferences using the form provided on the homepage.

Service Announcements
